Some of the more common examples of medical malpractice claims are when somebody goes in for surgery on their right knee, for example, and they operate on the left knee, or they go in for an operation and the doctor leaves the instrumentation inside or they will tell you that they are going to do a certain kind of operation and they do a different operation or they go in to do an operation and it’s supposed to be a simple operation and they clip an artery or things of that nature, or they fail to diagnose you properly.
Sometimes they tell you, “Listen, you just have a cough, cold or flu. Everything is okay”, and “Just go home” and you go home and you take cough, cold or flu medication for several months and you keep going back to the doctor and the doctor says, “Everything is okay. It’s just a cough, cold or flu.” You find out a year later that you actually have cancer and it’s advanced stage now and there’s no hope anymore. Had it been discovered earlier, you would have been fine. Failure to diagnose is a very common malpractice claim.
