The Impact Vocational Experts Have on Your Fort Lauderdale Workers’ Compensation Benefits

WorkersComp3

You suffer on-the-job injuries in Fort Lauderdale, reach a maximum level of medical improvement, and your doctor assigns an impairment rating. Now, a vocational expert enters your case, and suddenly someone who has never met you is telling a judge what jobs you could theoretically do and what you might potentially earn.

Unfortunately, that opinion can directly reduce your benefits. Our experienced Fort Lauderdale workers’ compensation lawyer explains what vocational experts do, when they appear, and what their assessments actually mean for your benefits.

What Vocational Experts Do in Fort Lauderdale Workers’ Comp Cases

A vocational expert evaluates an injured worker’s ability to return to the workforce given their physical limitations, age, education, work history, and the local job market. In Florida workers’ compensation cases, they are most commonly brought in after a worker reaches maximum medical improvement and a dispute arises over permanent disability status or the worker’s future earning capacity.

Under Section 440.15 of the Florida Statutes, you need to establish that there’s no sedentary employment available within a 50-mile radius. Vocational experts either support or undermine that argument. Their assessment typically covers:

  1. A review of the worker’s physical restrictions as documented by the authorized treating physician and any IME physicians.
  2. An analysis of the worker’s education, work history, transferable skills, and any vocational training.
  3. A labor market survey identifying jobs that the worker could theoretically perform.
  4. An earning capacity analysis projecting what the worker could realistically earn in those identified positions.

Their assessment includes a formal written report that becomes part of the legal record and is used in settlement negotiations or formal hearings.

How Insurers Use Vocational Experts in Fort Lauderdale Workers’ Comp Claims

Insurers retain vocational experts strategically, intending to show that the injured worker could earn a meaningful income in some other capacity, reducing or eliminating the need for permanent total disability benefits.

The problem is that theoretical availability and actual employability are not the same thing. Ways to challenge their assessment:

  • The worker’s own vocational expert conducts an independent labor market survey and reaches a different conclusion about realistic employment options.
  • Medical evidence from the treating physician documents functional limitations more specifically than the insurer’s IME report.
  • Evidence of unsuccessful job searches demonstrates the worker’s genuine inability to find employment.
  • Testimony regarding how pain, fatigue, and medication side effects affect a worker’s ability to sustain consistent employment.

The more detailed and realistic the picture of what the injured worker can actually do, the harder it is for insurers to dispute benefits.
