When can an Uber driver file a claim against Uber for an accident?

It depends on the circumstances, and it can get complicated. To be covered, you must have been logged onto the Uber app at the time of the accident. You might also have to rely on your own (or the other motorist’s) insurance first, and turn to Uber insurance only if this amount is insufficient.

What are my options if my loved one died in an accident caused by an Uber driver?

The personal representative of the deceased victim’s estate can file a wrongful death claim, either by asserting it against the appropriate insurance company or, if negotiations fail, by filing a lawsuit. Estate representatives are typically named in a will or estate plan. Otherwise, a probate court will appoint a personal representative (typically a relative).

I was seriously injured in a collision with an Uber driver. Can I recover for my injuries if the accident was partly my fault?

Florida operates on a “pure comparative negligence” system, whereby your damages will be reduced by your percentage of fault.

  • If you were 40 percent at fault, for example, you can recover 60 percent of your damages.
