What to Do in Case of an Accident

If you are involved in a Lyft accident (whether or not you were riding in a Lyft vehicle), it is important to take the following steps, to the extent that your injuries will permit:

  • Take photographs of the accident scene, all vehicles involved, your injuries, and the drivers’ licenses and insurance information of any potential defendants.

Lyft Driver Insurance

A Lyft driver’s personal insurance policy probably will not pay out on a Lyft accident claim, at least not if the driver was carrying a passenger or on his way to meet a passenger. This is because most auto insurance policies exclude coverage for accidents that occur while engaged in commercial activities.

Florida law requires either the driver, or Lyft itself, to offer insurance with certain minimum coverage limits that covers commercial driving. Lyft driver insurance can pay out even when the driver’s personal insurance policy will not cover the accident. It can also pay out if a passenger is injured in an accident caused by an uninsured third-party motorist.

What are the minimum auto insurance coverage requirements for Lyft drivers in Florida while the driver is providing a ride?

Florida law requires:

  • Liability coverage for bodily injury, death, and property damage of at least $1 million; and
  • The same Uninsured Motorist and Personal Injury Protection insurance that is required of other Florida drivers.

What are the minimum coverage requirements for Lyft drivers in Florida while the driver is logged on but not providing a ride?

Florida law requires:

  • Liability coverage for death and bodily injury of at least $50,000 per person and $100,000 per accident;
  • Property damage coverage of at least $25,000 per accident; and

As a passenger, am I still covered by Lyft driver insurance if the driver didn’t formally accept my ride request through the Lyft application?
