For unknown reasons, the incidence of hit-and-run car crashes has been increasing every year recently, and they now make up nine percent of car accidents. Regardless of the reasons for the increase, some facts remain constant: hit-and-run accidents are especially dangerous and unacceptable. The Law Offices of David Benenfeld can help.

Car accidents happen for many reasons, most often caused by a driver’s negligence, including speeding, drunk driving or distracted driving. Florida law requires drivers in an accident to stop and exchange information. If the accident involved personal injury or more than $500 in property damages, the police need to be notified as well.

Leaving the scene of the accident is not only illegal, but it is especially cruel and dangerous to leave injury victims to fend for themselves. Failing to call for help or render aid can make a person’s injuries so much worse than they otherwise might have been. Sunrise personal injury attorney David Benenfeld is here to hold hit & run drivers responsible when they won’t hold themselves responsible. If the driver can’t be found, we can still help you get compensation for your injuries. Call the Law Offices of David Benenfeld in Sunrise, Fort Lauderdale and West Palm Beach after a hit & run car accident in Broward, Miami-Dade or Palm Beach County. Our lawyer will help you get the care and compensation you need for your serious injuries.

What do I do if the driver who hit me flees the scene?

Call the police. Leaving the scene of the accident is a crime, and the police might be interested in tracking down the driver. Any information you can give the police about the car that hit you – color, model, distinguishing marks, any part of the license plate number – can help the police locate the car. There may be traffic cameras in the area they can search, witnesses may come forward, or body shops may report when a suspect vehicle comes in for repairs. Don’t think there is nothing you can do to find the driver without trying first.

Call a lawyer. The police may or may not devote significant resources toward tracking down a hit-and-run driver, but your attorney can hire investigators and do many of the same things the police would do in locating the driver. Once we find the driver, we can pursue appropriate legal action against them directly or their liability insurance, if applicable. A claim against a hit-and-run driver is also likely to include a demand for punitive damages to hold the driver accountable for such outrageous behavior and serve as a reminder to others that our Broward County communities will not accept hit-and-runs.

If we can’t find the driver, our experienced Sunrise car accident lawyers can still help by representing you in an uninsured motorist claim. Hopefully, you carry bodily injury liability insurance, and if you do, you likely have uninsured motorist (UM) coverage as well. UM is often offered together with BI coverage. You can purchase as much UM coverage as you have BI coverage, and you can also stack your UM coverage if you have multiple vehicles covered by insurance. UM coverage can be used in a hit-and-run, and these claims are often sufficient to fully compensate you for your serious injury medical bills, lost wages, and pain and suffering damages.

Keep in mind that just because a UM claim gets filed with “your” insurance company instead of the at-fault driver’s, you are still in an adversarial relationship when it comes to getting full value for your claim. The insurance company will still send out an adjuster who will downplay how serious the crash was and offer you a settlement amount that does not cover all your damages. They may also demand a lot of documents and proof regarding the accident and make it especially hard for you to pursue your claim. Broward County personal injury lawyer David Benenfeld and his team know how to deal with insurance companies in UM and other claims and secure the compensation due to you for your injuries.
