Restraining Residents Is Considered Florida Nursing Home Abuse

When you visit your loved one in the nursing home, is he or she being restricted by restraints? While a nursing home worker may give you a reason why your loved one is being restricted by restraints, it is important that you understand that the use of restraints can be a sign of physical abuse, neglect, or sexual abuse.

Some nursing home workers use restraints so they can get away with:

  • slapping or hitting residents
  • shaking residents
  • molesting or inappropriately touching residents
  • forcing residents to do something they don’t want to do
  • neglecting residents so their jobs are easier

While some nursing home staff members use restraints to get away with committing acts of physical or sexual abuse, most nursing home employees use physical restraints for the purpose of convenience. When they tie up residents to their beds and chairs, they know they don’t have to check on them as frequently. Sadly, the wrongful use of restraints is occurring in more and more Florida nursing homes because many nursing homes lack the necessary staff to provide the correct care and supervision to their residents.

When nursing homes use restraints they are taking away a resident’s rights and freedoms. This can affect an elderly resident’s dignity and quality of life. Not only can a resident suffer from the physical effects of being restrained, but a resident may suffer emotional and mental injuries as a result of being restricted against his or her will. If restraints are used to sexually abuse a resident, that resident could also suffer from sexual trauma and sexually transmitted diseases.

It is frightening to think that some nursing homes have this power and use excessive restraints upon their residents—committing Florida nursing home abuse. At the Law Office of David Benenfeld, we believe in fighting for a patient’s rights, for justice, and against nursing homes that use restraints.

If you believe your loved one has been wrongfully restrained, your loved one may have a claim against the nursing home as a victim of excessive restraints. To find out your loved one’s rights, please contact our office at 866-9 HELP NOW or 866-943-5766 to speak with a knowledgeable nursing home abuse attorney in Fort Lauderdale in a complimentary consultation today.
