CNA Workers’ Compensation Claims

WorkersComp5

Employees in Pompano Beach or anywhere else in South Florida who are injured on the job should immediately take steps to seek workers’ compensation benefits. It is critical for employees to know with certainty whether their employers are required to have workers’ compensation coverage (most employers in Florida are required to have coverage), and through which insurance company their employer has coverage. In South Florida, many employers have coverage through CNA, which is an insurance company that provides workers’ compensation coverage and many other types of insurance to parties in the U.S. as well as other parts of the world. Like any other insurance company, CNA will be focused on its bottom line, and it will want to do what it can to avoid having to pay a claim.

If you are having difficulty with the claims process, or if you have been denied coverage by CNA following an injury that arose out of your employment, you should get in touch with an experienced Pompano Beach workers’ compensation lawyer as soon as possible to discuss your CNA claim and what you can do to obtain coverage.

What to Know About CNA and Workers’ Compensation Insurance

 Before we discuss CNA and the coverage it provides to employers in Florida, it is important to learn more about workers’ compensation coverage and this type of insurance. Workers’ compensation is a form of insurance that many employers are required to purchase in the event that an employee sustains a compensable injury on the job. Under Florida law, an employee’s injury must arise out of their employment, and it must occur in the course of their employment, for it to be compensable. Workers’ compensation insurance is no-fault insurance, which means that there is no need for an employee to prove negligence in order to be eligible for compensation. Likewise, in most cases where an employee’s own negligence contributed to the injury, the employee can still be eligible for compensation.

Which employers are required to have coverage? According to the Florida Division of Workers’ Compensation, most employers who conduct work in the state of Florida must have workers’ compensation coverage for their employees. The following are the requirements for covered employers:

  • Construction employers with 1 or more employees must have workers’ compensation coverage;
  • Agricultural industry employers with 1 or more regular employees or 12 or more seasonal workers must have workers’ compensation coverage; and
  • Non-construction and non-agricultural industry employers with 4 or more employees must have workers’ compensation coverage.

The requirements for agricultural industry employers are slightly more complex than for other types of employers, so it is important to ask a lawyer for clarification if you were injured while working for an agricultural industry employer.

How CNA Provides Workers’ Compensation Coverage

CNA is an extremely large insurer that provides workers’ compensation coverage to employers in Florida and elsewhere. How do employers end up with coverage through CNA? In Florida, employers must purchase workers’ compensation coverage and can determine the company through which they purchase required coverage. Given the history and broad geographic reach of CNA, many Florida employers choose coverage through this insurance company. As CNA explains, it provides workers’ compensation insurance to cover medical expenses and wage replacement benefits for employees who sustain injuries in the course of their employment.

Insurance companies, including CNA, are never on the side of the insured. Even if your employer has been a loyal CNA customer for years, and even if you have another type of insurance policy yourself through CNA, the insurance company will not be on your side. As such, CNA may look for reasons to lawfully deny your claim. In those cases, you should immediately seek help from an attorney.
