Can I Seek Workers’ Compensation If I Got Hurt While Traveling For Work?

Driver3

If you got hurt while you were traveling for work in or around Pompano Beach, you could be eligible to obtain Florida workers’ compensation benefits, but it will be important to determine whether the travel arose out of and occurred in the course of your employment. Under Florida workers’ compensation law, only injuries “arising out of and in the course of employment” are eligible for compensation. Our experienced South Florida workers’ compensation lawyers can provide you with more information about the various types of work-related travel in which injuries may occur and for which you will likely be able to seek workers’ compensation benefits.

Travel is Part of Your Job

If your regular job duties involve travel, and you are injured while you are traveling for these job duties—from being a delivery driver to work that requires visits to client businesses, for example—you may be eligible for workers’ compensation. You should have one of our workers’ compensation lawyers evaluate your case to determine how you can seek compensation.

Work-Related Errand Requiring Travel During Your Working Hours

If your job does not typically require you to travel or run errands but your boss asks you to run a one-time errand, and you sustain an injury while running the errand, this injury should be compensable through the Florida workers’ compensation system.

In-Town Travel for a Job-Related Duty

Job-related duties that require you to travel from one place to another in town, even if it is a one-time trip, while you are on the clock is typically “work.” Accordingly, if you are injured during this type of travel, you may be eligible for workers’ compensation benefits if you get hurt during this type of in-town travel.

Out-of-Town Travel for Work

Employees who regularly travel out of town for work, and even employees who take one-time trips out of town for work, can usually seek workers’ compensation if they are injured while on a work trip. Our Pompano Beach workers’ compensation lawyers can evaluate your case and help you to seek compensation for your injuries.

Learning About When Travel is Unlikely to Be Compensable

While injuries suffered by an employee during the examples of work-related travel described above should be compensable through the Florida workers’ compensation system, it is also important to understand when travel-related injuries may not be compensable. The primary example of travel-related injuries for which a worker cannot seek compensation through the workers’ compensation are those injuries that occur during a commute.

Commuting involves traveling to or from work, including to or from a jobsite. Commuting can be a short distance, such as a five or ten minute ride on a city bus, to a lengthy commute that requires a multi-hour drive each way. In short, injuries that happen in a commute are unlikely to be compensable through the Florida workers’ compensation system.
