Dog bites and dog attack injuries are one of the most common types of premises liability cases in Florida – and it is important to understand that dog bite laws and aggressive animal laws can vary by state, by county, and by city.
This week the spotlight is on Broward County, Florida, where a dog attack has drawn attention to just how strict dog bite laws can be. Broward County has some of the strictest aggressive dog ordinances in the country – ordinances that are meant to protect Florida residents from dangerous dogs, dog bites, dog attacks, and serious animal bite injuries.
On May 27 in Fort Lauderdale, a Broward County judge ruled that Brandie, a 10-year-old Husky, should be put to sleep after killing a poodle during a dog attack earlier this month. While the family of the dog argued that their pet was not aggressive or dangerous to others, the judge could not look past the evidence that the dog lunged at the smaller pet, breaking its neck.
This family is not the first to argue against the very strict dangerous dog ordinance, which states that a dog should be put down if:
- The dog approaches a human in an attacking fashion without being provoked.
- The dog has killed another domestic animal not on the dog owner’s property.
- The dog has ever harmed, attacked, or injured a human, either on the owner’s property or on someone else’s property.
- The dog has been involved in organized dog fighting.
These Broward County dog bite laws are meant to protect both animals and humans in Florida from dangerous dogs, both on private property and public property. Far too often, dog attacks can lead to serious injuries, scarring, deformities, emotional issues, post-traumatic stress disorder, medical bills, lost wages, and other losses. In some cases in which a person was attacked by a dog with a negligent owner, the dog bite victim may have a premises liability case and may file a Florida dog bite lawsuit.
