I’ve been hurt in an automobile accident, where’s my $10,000?
Hi, I'm David Benenfeld, personal injury lawyer. I want to talk with you today about a question that a lot of clients ask. That question is, very simply: I've been hurt in an automobile accident, and I see these commercial on TV all the time saying I'm entitled to $10,000. So they come in and they say, "OK, I've been hurt. Where's my $10,000?"
And the answer to their question is, quite simply, the commercials that you're seeing are very misleading.
What they should be saying to you is: When you get hurt in an accident in Florida, you are entitled to what we call Personal Injury Protection benefits, or PIP benefits. Or, you may have heard it as No Fault benefits. And those benefits pay up to $10,000 of your medical expenses, minus whatever deductible that you have. Or, it can potentially pay 60 percent of lost wages, until a total of $10,000 in benefits are paid out.
So, it's not that your claim will settle for $10,000. It is rather that these benefits you are entitled to ... should you desire to use them and should you need to use them ... if you have the required insurance in place that the state of Florida says that you must have. And that is how it works.
