What they should be saying to you is: When you get hurt in an accident in Florida, you are entitled to what we call Personal Injury Protection benefits, or PIP benefits. Or, you may have heard it as No Fault benefits. And those benefits pay up to $10,000 of your medical expenses, minus whatever deductible that you have. Or, it can potentially pay 60 percent of lost wages, until a total of $10,000 in benefits are paid out.
So, it's not that your claim will settle for $10,000. It is rather that these benefits you are entitled to ... should you desire to use them and should you need to use them ... if you have the required insurance in place that the state of Florida says that you must have. And that is how it works.

The answer to your question is: If you have been hurt in an accident while working, during the course and scope of your employment ... whether you are on the premises of your employer, or you are not on the premises of your employer, you're entitled to Worker's Compensation benefits. And you absolutely should file a claim. If you fail to file the claim within the prescribed period of time, you could lose all benefits. It is absolutely important that you do file that claim and you get the medical care. And if your employer fires you because you filed a claim on your Worker's Compensation, you have a different claim, called a Retaliatory Discharge.

People come in and they have back injuries, or they'll have leg injuries, or foot injuries, or ankle or shoulder or head injuries. Some of the injuries that people have are catastrophic. Some of them that they have are painful, yet they don't have broken bones, or they're not surgical. But with all of these claims, the answer to the question is: It depends. It can depend on how old somebody is, or what kind of condition they were in beforehand.
For example, if they were an elderly person and they could barely move. And now all of a sudden, they have a toe injury. And because of that toe injury, now they can't move at all ... is a lot different than somebody who is young and has a toe injury, and heals up very quickly.
By the same token, you have an injury and the question is: How much time did you miss from work? Or, will that injury affect your ability to play sports, or do certain things, or work in certain ways, and be as productive as you possibly can? Or, enjoy your life as much as you possibly can? Which also falls into the realm of: Is your claim a Personal Injury claim? Or, did it happen on the job? And if it happened on the job, there are different rules that apply. So, the value of the case could be entirely different.
It's kind of like if you want to buy a car. You really don't know much about how much the value of the car is until you sit in it, and you drive it, and you have your mechanic look at it. And he looks at the history, and any kind of accidents that the car has been in. Or, if there was a break down of the engine. And that's kind of similar to when you have an accident and you are hurt. And now you have back pain. And you never had back pain before. And the question that you want to know is: What is the value of my case?
