Wrongful Death Lawsuit Filed after Fatal I-75 Crash

A wrongful death lawsuit has been filed, accusing a construction crew of contributing to an 11-vehicle crash on I-75, which caused two fatalities last October.  The families of the two men who died have received $500,000 settlements from the insurance company of the semi trailer driver who drove into stopped traffic.  The family of James Brashear of Sarasota is also blaming Zep Construction in the lawsuit stating that construction workers for the company did not adequately warn drivers of a closed lane on the interstate.

There were roadblocks in the northbound lanes that stopped traffic on the north side of the Bee Ridge Road overpass.  According to a Florida Highway Patrol report, drivers complained that they did not have enough time to react.  Some people believe that there should have been more signs warning of the roadblocks.  A supervisor with Zep Construction told investigators that the roadblock followed all state rules.

The semi trailer that hit James Brashear’s car had accelerated up the hill and barely slowed down before hitting his vehicle at 70 MPH.  Brashear’s twelve year old son was also in the car and was seriously injured.  He survived the crash, but the trauma has him visiting psychologists and a counselor.

The semi trailer also hit a 1996 Honda sedan, which killed a man and went on to hit more vehicles.  The driver of the semi trailer was not criminally charged, but was cited with careless driving.
