Wrongful Death Lawsuit Against Town Center Mall

Several property owners were added last month to the wrongful death lawsuit against the Town Center mall in Boca Rotan.

Before Nancy Bochicchio and her 7-year-old daughter, Joey, were killed, the owner of Town Center mall, Simon Property Group and other property owners were notified about security issues at the mall, but did not take measures to protect shoppers, according to the wrongful death lawsuit. The lawsuit was originally filed in January on behalf of JoAnn Bruno, Bochicchio’s sister.

On December 12, 2007, Bochicchio, 47, and her daughter were found tied up and shot dead in their SUV in the mall’s parking lot.

Bruno was quoted in a previous interview with WPTV- Channel 5 as saying, "She was my sister, my friend, my heart. I mean when I lost my mom and dad I had a hole in my heart. And this has taken away literally half of my heart. I'll never feel the same again." During that interview Bruno and her husband also shared their sorrow and happy memories of the single mom and her daughter.

Bruno and her husband believe that Bochicchio had fought to save her daughter.

The property owners named in the wrongful death lawsuit include Sears Roebuck and Co., Bloomingdale’s Boca Raton Real Estate Inc., Burdine’s Real Estate Inc. and individual trustees Hans C. Mautner, Michael L. Johnson, G. Martin Fell, J. Michael Maloney and Mark S. Ticotin.

Reporters attempted to contact the attorneys representing these property owners via telephone, but they could not be reached for comment.

According to Bruno’s attorney, David Shiner, if the wrongful death lawsuit is successful, it will “vindicate” the two lives that were tragically lost.

"At the end of the day, there's a thing called accountability. When all is said and done, the mall and property owners have a responsibility and accountability to the community and to the people that patronize their business." said Shiner.
