  • Davie Motorcyclist Crashes into Woman’s Car
    Nov 30, 2011

Christopher Blair, A Davie resident in his 30’s was driving a motorcycle northbound on North Nob Hill Road near Northwest Sixth Street Monday morning.

Blair ran a red light and crashed into a southbound car that was turning east, Plantation Police Detective Robert Rettig said.

The motorcyclist Blair was injured and transported to Broward General Medical Center in Fort Lauderdale.  “I’m told he’s going to be OK,” Rettig said.

Police cited Blair for running a red light, driving while his license is suspended and riding a motorcycle without an endorsement on the license.  The endorsement indicates that he would have completed training to operate the bike, the detective said.

“He should not have been riding a motorcycle at all or operating a vehicle, because the license was suspended, Rettig said.

Police did not provide details about the other driver, a female.

The Office of David Benenfeld would like to remind the public to observe traffic laws and drive safely in order to avoid South Florida motorcycle accidents.

    • Miami Assisted Living Facility Fire Forces Residents Outside
      Nov 20, 2011

Just before dawn on November 9, 2011, 50 elderly residents of a West Miami assisted living facility were forced to evacuate from their apartments due to a fire.

Miami-Dade Fire Rescue received a call reporting the fire at the Pointe North Gables living facility at 5890 SW Eighth St, at 3:40 a.m.

Chief Patrick Kelly Rowan of Miami-Dade Fire Rescue said, “We called in a second alarm to help evacuate at least 50 elderly residents who needed assistance in evacuating.”

When firefighters arrived on the scene, they saw heavy smoke coming from the northwest corner of the three-story building.

Three residents were treated and taken to a nearby hospital.  One of the men evacuated was unconscious where the blaze started.

Lt. Eddy Ballester, a spokesman for Miami-Dade Fire Rescue said, “The sprinklers activated, not only keeping the fire from spreading, but alerting the fire department in a timely manner.  The sprinklers saved people’s lives and allowed us to save others by keeping the fire contained.”

Residents were forced to stay outside through the morning even though the fire was contained and extinguished.  Two Miami-Dade County buses were brought out for the residents to sit in while they waited to go back inside.

The West Miami Police and Miami-Dade fire investigators are looking into the cause of the fire.

The Law Office of David Benenfeld would like to thank the Miami-Dade Fire Rescue for their quick response in assisting these seniors, and also a speedy recovery to the seniors who were hospitalized.

    • South Florida Elder Abuse Rising
      Oct 15, 2011

Unfortunately elder abuse in South Florida is going up.  The Department of Children and Families are asking the community to step in and deal with this problem.

Interesting enough according to state statistics, from July 2010 through June 2011, Broward County had 5,193 cases of reported elder abuse that was up 525 cases from the previous year.  Palm Beach County reported there were 3,957 cases from 2010 to 2011 which was an increase of 441 cases the year before.

Many times there are outward signs that people can notice if there is elder abuse or neglect.  Officials said that just by noticing an elderly neighbor’s unkempt home or lawn can be signs of neglect and abuse.

Care givers for the elderly can be a problem with cases of exploitation.  Greenacres police said an elderly couple’s caregiver used their checkbook to steal $141,228 in August 2010.

Family and friends as well as the community need to take notice of anything that does not appear normal in the life of a senior.  It is important to make sure the senior is not missing money, have items missing or shows any physical signs of abuse.

Last year, DCF introduced a program utilizing 12 court-appointed “elderly guardians” for Palm Beach and Broward counties.  The guardians are responsible for looking after the elderly who do not have family available.

The Law Offices of David Benenfeld would like to extend its concern for the elder’s who have found themselves in any abusive situation.

      • Volkswagen and BMW Recalling Vehicles
        Jan 20, 2012

BMW and Volkswagen are recalling more than 500,000 vehicles because of technical problems.

Last October Volkswagen began a recall of 299,000 cars with diesel engines because of possible cracks in the fuel-injection system. VW has notified owners but does not say how many of the recalled vehicles responded.

The VW models affected with the cracks are the VW’s Golf, Passat, Jetta, Tiguan and other models that have been built since 2009.  Other models affected are Audi, Skoda and Seat.

BMW also has reported a recall of 235,000 cars of its Mini brand worldwide due to a malfunction of the electric water pump that cools the turbo charger.  No reported accidents have been reported due to the malfunction.

The National Highway Traffic Safety Administration says that BMW will recall 88,911 Mini and Mini Cooper cars in the United States.

The auxiliary water pump is used to cool the turbo charger that has an electronic circuit board that can malfunction and overheat.  If this happens the circuit board can possibly catch on fire.

The recall will begin next month.  BMW will contact the car owners and dealers.  The water pump will be replaced free of charge.

The Law Office of David Benenfeld would like to remind Volkswagen and BMW owners to be aware of these recalls and make sure they have their vehicles inspected.

      • SUV’s and Minivans Being Recalled by Ford
        Jan 15, 2012

Ford is in the process of recalling 539,000 vehicles to repair defects in their SUV’s and minivans. This includes 286,000 Ford Escape SUV’s in the 2001 and 2002 model and approximately 253,000 Ford Freestar and Mercury Monterey minivans for models in 2004 and 2005.

The 2004 and 2005 models are being recalled because their torque converter output shaft may fail.  The 2001 and 2002 models are being recalled because their brake master cylinder reservoir cap could leak brake fluid.  This could cause an electrical short in the antilock brake system leading to smoking or fire in the vehicles.

Ford has said that there have been no reports of injuries do to the problem but have had some reports of property damage as a result of fire beyond vehicle damage.

Even though the potential for fire is low, it is recommended that the vehicles be parked outdoors away from structures until this recall repair is performed.

The 2004 and 2005 models recalled for the Ford and Mercury minivans that are for a defective torque converter can cause the vehicle to lose “motive” power, or the ability to move forward and reverse, without warning.  When a vehicle loses motive power the engine continues to run and you can still steer and stop, but it increases the risk of a crash.

The Law Office of David Benenfeld would like to warn owners of these vehicles to respond to Ford’s recall and take their vehicles into the dealerships when the parts are available for replacement.
