Allstate in On-Going Florida Court Battle

We previously reported here, that Allstate is refusing to comply with discover requests despite a $25,000 a day fine related to litigation in Missouri.  Well, Kevin McCarty Florida’s Insurance Commissioner used the power of the Office of Insurance Regulation (OIR) to bar the company from writing any new policies in the state of Florida.

The ban lasted all of two days.  On Thursday, the First District Court of Appeal in Tallahassee, Florida, upheld a lower court’s stay on the ban.   OIR now has ten days to respond with arguments as to why the stay should be lifted.

Allstate is refusing to turn over the McKinsey documents, which many plaintiff’s lawyers believe contain a plan for summarily denying valid insurance claims in an effort to become a more profitable company.

McCarty’s anger with Allstate is understandable, as the corporation is willing to incur millions of dollars in sanctions in the Missouri litigation, but is not willing to do anything to make homeowner’s insurance more affordable in Florida.
